1. General premises

These terms and conditions govern the contracts of sale between the purchaser (hereinafter referred to as the "Customer") and RF Elettronica di Rota Franco, (hereinafter referred to as "RF"). The general selling conditions herein govern all the contracts of sale entered into between the Customer and RF through the web site www.rfmicrowave.it. Each contract is subject to the general selling conditions published on the web site at the time when the order is sent. Any change proposed by the Customer shall not modify the general selling conditions, unless an explicitly written acceptation by RF.

Language: the present selling conditions are drawn up in Italian and English. In case of translation non-compliance, the Italian language shall prevail.

2. Prices

All prices are meant to be in Euros (€) and do not include taxes and charges. In particular, VAT tax (where applicable) and freight costs will be specified in the order and will be calculated in accordance to the taxes in force when the invoice will be settled.

Products prices are listed in the catalogue section. Prices are fixed, excepted RF right to change them without notice. Prices for Customer are on the catalogue, excepted different or particular conditions accorded with RF. If prices are not listed or in case of orders of product not in catalogue, prices must be requested to RF before ordering.

3. Orders

Orders net minimum amount (net = taxes and freight cost not included) shall be:
- 30,00 € for private customers.
- 60,00 € for companies.

Particular Quotations: Customer interested may request a particular quotation or big quantity (big quantity are meant to be for single product). Particular quotation wont'be done for quantities already quoted in the catalogue. All orders are accepted after availability check and consequent payment request. RF reserves the right to delete an order, even if accepted, informing immediately the Customer, in case of payments already done, RF will refund the amount.

4. How to order

Orders are collected by our website, for particular procedure Customer is requested to contact RF staff.

To process an order Customer has to register to the provided form, then you can log on your "MyRF" private area and from here manage all orders and personal information. Registration is free and without any kind of obligation.

Orders can be saved as draft and modified before definitive dispatch, modifications are always possible, unless after the payment.

5. Subject to prior sale

RF products are available and ready in stock, all sales are "subject to prior sale". In case that an ordered product is no more available, the Customer is informed and can modify or delete the order.

6. Freight charges

RF reserves the right to change freight costs without any notice.

Freight rates are indicative, for hard to reach areas may be charged an extra fee.

Registered post

This kind of shipment is possible for small volumes (maximum 2 kg, a packaging thicker than 4 cm is not allowed even if not heavy; in this case shipment will be by TNT courier).

With fragile, heavy or bulky goods RF reserves the right to choose TNT courier shipment instead of registered post, upon communication to the Costumer

Freight rates will be calculated upon destination country, volume and weight. Indicatively costs span from 30,00 € to 60,00 €

7. Payments

All advanced payments have to be received within 10 days after our communication, elapsed this time a second payment request will be sent and after other 10 days the order will be automatically delete without other communication.

RF do not accept different payments from these listed below, exceped different agreements.

Ricarica Postepay (Italy only)

Postepay card number will be provided after availabilty check. This kind of payment can be made in every Italian post office or on-line on Italina post web site with a cost of 1,00 €.

Credit card

>Our payment gateway X-PAY is managed by CartaSi and provides a secure server that guarantees the maximum protection and privacy of transaction using a secure SSL protocol at 128bit. Accepted cards are: VISA, VISA Electron, MASTERCARD, MAESTRO

PayPal

Once we check ordered products availability, we will send an email with instructions for payment by Paypal. Paypal is a secure payment system managed directly by Paypal.

Bank transfer

Once we check ordered products availability, we will send an email with instructions for payment by bank transfer

Cash

Cash payment is possible only for pick up at our offices

Cash on delivery (Italy only)

Cash on delivery is available only for orders amount up to 500,00 € and Italy as destination.

Cash on delivery has an extra charge of 2,00 to 5,00 €.

NOTE: For all advanced payments, information will be sent by email after we receive and check the order to guarantee effective product availability

8. Delivery

All products in the catalogue are ready in stock, so all orders are generally processed within two working days after payment. RF will delivery to the address specified in the order and according to freight rates listed in these "selling conditions" and confirmed at payment request. Shipping costs are charged to the Customer, excepted different and previous agreements with RF sales manager.

Notwithstanding previous conditions, RF reserves to change shipping method, if shipment type chosen in the order presents objective impossibilities (weight or volume limits etc..).

9. Refurbished products selling conditions

We inform our kind Costumer that refurbished products may be listed in the catalogue and properly indicated by RF. These products are sold by RF after careful tests that guarantee the same functionality as brand new products. Sale of these products is regulated by these "selling conditions", like all our products. The Costumer may also ask about aesthetic and wearing conditions.

10. Products check, delay and missing delivery

The Customer has to check packaging and goods when delivered and in case of damaged boxes could refuse the delivery or can conditionally sign, informing immediately RF, otherwise, delivered goods will be considered properly accepted.

In case of faulty products, Customer has to communicate to RF within 8 (eight) days after delivery. Elapsed this period without communication products will be considered definitively accepted.

11. Product information and availability

RF recommends all customers to check, where available, technical parameters and documentation of products before purchase like their future availability in case of particular usage.

DATASHEET: for some products datasheets are available on the website, for the others we can provide it on request or at least the component pinout, so if interested you are kindly requested to ask it expressly on the order.

12. Liability limit

All customers are kindly requested to check the goods as soon as they received the shipment, both in terms of quantity and technical features.

In case of delivery not corresponding to the order, RF will provide to replace the goods or refund the amount.

Should the Customer do not check goods at the delivery and before using, he could not claim compensation for damages due to usage of wrong (not correspondent to requested technical features) or faulty supplied products; for example he could not claim for damages such as repair or replacement costs, any kind of intervention, profit loss, travel or temporary transfer, extra costs, etc...

13. Currency

Prices of products are expressed in Euro (€) all payments have to be made in Euro (€), RF is neither responsible nor provides information about currencies exchange rates in a given period for other currencies.

14. Returned products

Returning goods will be possible only after written agreement of RF. Then will be communicated ways and terms to proceed for return or replacement.

Custom made products return will not be accepted, except faulty products or goods not correspondent to order due to errors not imputable to the Customer.

15. Order cancellation and modification

It is possible to change the order if not already paid. Otherwise modifies, additions or corrections will not be allowed.

RF reserves the right not to maintain commercial relationship with Customer and reserves also the possibility to delete any order upon communication to the Customer.

16. Force majeure

If RF supply activity would be obstructed by force majeure, accidental events or impossibility to access to some service or materials, RF could delay orders delivery and in this case informing the Customer, who could delete the order within 3 days. In the cases listed above, RF is not responsible.

17. Privacy policy

Personal information are stored by manual or automated intruments that guarantee security and privacy of data. Personal information are used within the normal commercial activity exclusively aimed to manage relationship with Customer and not yielded or communicated in any case to third parties for purpose other than described, Customer can at any time view, modify or ask for deletion of his information.

18. Web site terms of use

RF web site access and usage is allowed according to following terms and conditions.

This terms can be changed at any time by RF without any notice; so they have to be checked regularly by Customer. Keep using this web site is considered as acceptance of this terms.

The not or delayed exercise of RF rights based on these terms of use do not in any way affect the right of RF to enforce them.

19. Copyright

All web site contents including texts, images and layouts are property of RF but can be used for personal or commercial purposes only after request to RF, in any case is not allowed any modifications to these contents. All rights are reserved.

20. Liability exclusion

RF disclaims any liability for damages (direct, indirect or consequential) and responsibility arising from access or usage of information contained on this web site or accessible through the web site.

RF does not agree or endorse the content of third party web sites and does not assume any responsibility in relation to their content.

RF does not guarantee that functionalities, materials and information available on this web site will be not interrupted or error free, that defects will be corrected. The user of the web site is in any case required to implement procedures and systems to check for viruses (including anti-virus and other security systems) sufficient to ensure particular requirements for safety and accuracy of data input and output.
